Insofar as you do not agree with the further developments occurring over time, you may, in writing, pursuant to Article 17 of the EU General Data Protection Regulation (EU-GDPR), demand for the deletion of data, which is not stored on the basis of other statutory provisions, such as commercial or fiscal retention requirements.
Anonymous data collection
You can in principle always visit the Elma website, without disclosing who you are. Elma only gets to know the name of your internet service provider, the website from which you have accessed Elma's website and the webpages you visit on Elma's website. This information is analyzed for statistical purposes. You remain anonymous as an individual user.
Collection and processing of personal data
Personal data is only collected, insofar as you voluntarily disclose it to Elma, for example, for the purposes of the newsletter registration. Elma thereby complies with the provisions pursuant to Art. 5 and 6 of the EU-General Data Protection Regulation (EU-GDPR). Export and processing of data in States outside of the European Economic Area
Insofar as an export of your personal data should take place to States outside of the European Economic Area (hereinafter EEA), Elma shall ensure that the data importer shall only process this data on the basis of a level of data protection, which is equivalent to the level of data protection, which the Elma in its capacity as the controller, is in turn obliged to comply with, pursuant to the relevant provisions of the EU-General Data Protection Regulation (EU-GDPR).
In addition, as long as you are logged-on to Facebook or own a Twitter account or a LinkedIn account or an Instagram account, personal data may be exported to the USA. Insofar as you are logged-on to Google or own a YouTube account, personal data may be exported to the USA. For further explanations and possibilities to prevent this data export, please refer to the section "Use of YouTube Plugins".
A transmission of personal data to Google within the framework of the use of analytical programs does in contrast not take place, because your IP address is only transmitted anonymously. Please read hereto the section "Use of analytical programs" of this data protection statement.
The service providers commissioned by Elma have their registered offices as well as operate their IT infrastructure, exclusively within the EEA. This also applies to any use of cloud-based services. The contracts concluded with the service providers comply with the data protection and data security provisions of the EU General Data Protection Regulation (EU-GDPR). Elma remains the controller of the data processing, irrespective of the involvement of external service providers.
Use and disclosure of personal data
The personal data collected within the framework of Elma's website shall only be used without your granted consent for the purpose of the processing of the contract and the processing of your inquiries. In all other cases, your data shall only be used for advertising and market research purposes by Elma, insofar as you have previously granted your consent. Moreover, your data shall not be passed on to any third parties. You of course reserve the right to revoke your respective granted consent at any given time with effect for the future.

Use of cookies
Elma uses so-called "cookies" to individually design and optimize the customer's online experience and time online. A cookie is a text file that is either stored temporarily in the computer's memory ("session cookie") or stored on the hard disk ("persistent" cookie). Elma also uses Google Analytics within the framework of the web analytics, a web analytics service provided by Google Inc. ("Google"), whereby Elma uses Google Analytics with the extension "_anonymizeIp ()". As a result, the IP addresses are processed only truncated to exclude a direct personal inference. Objection against the data collection and storage that takes place within this framework, can be raised at any given time with effect for the future.

The plugins are marked with a Facebook logo. Insofar as the customer calls-up a webpage of Elma containing such a plug-in, the customer's browser establishes a direct connection to the Facebook servers. Facebook transmits the content of the plugin directly to the customer's browser and it is then incorporated from this browser into the webpage.
Through the incorporation of the plugins, Facebook receives the information that the customer has called-up the respective webpage Elma's. Insofar as the customer is logged-on to Facebook, Facebook can assign the customer's visit to his/her Facebook account. Insofar as the customer interacts with the plugins, for example, presses the "Like" button or leaves a comment, the corresponding information is transmitted from the customer's browser directly to Facebook and stored there. Purpose and scope of the data collection and the further processing and use of the data by Facebook as well as the relevant rights and setting options of the customer to protect his privacy can be found in the privacy policy of Facebook.

YouTube is represented by Google Inc., with registered offices at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Elma uses on its website plugins of the provider YouTube. When you visit a webpage of Elma's website, which has a YouTube plug-in, a connection to the server of YouTube is established. Information about the webpage you have visited is then transmitted over this connection to the YouTube server. Insofar as you are logged-on as a member of YouTube, YouTube assigns this information to your personal user account. In the case of the use of the plugin, such as by clicking on the start button of a video, this information is likewise assigned to your user account. Use of RapidMail
Elma uses RapidMail for the processing of its non-individualised mail traffic, in particular the shipment of its newsletters, the sending of information material, feedback and advertising. RapidMail is a newsletter shipping platform of the German provider rapidmail GmbH, Augustinerplatz 2, 79098 Freiburg i. Br. Germany. Elma points out that the e-mail addresses of its newsletter recipients as well as other data is stored on the servers of RapidMail. RapidMail uses this data in particular for shipping and evaluating the newsletters on Elma's behalf. In addition, RapidMail is in a position to use this data for the continuous improvement of its own services. However, RapidMail does not use the data procured in this manner to address customers and website visitors for its own purposes nor does it disclose the data to third parties. Elma insofar trusts RapidMail’s reliability and IT as well as its data security, on account of the fact that RapidMail as German provider is committed to comply with the provisions of the of the EU-General Data Protection Regulation (EU-GDPR).
Use of Google Tag Manager
This website uses Google Tag Manager. Google Tag Manager is a solution that enables marketers to manage website tags from one interface. The tool itself (which implements the tags) is a cookie-less domain and does not collect personal information.
Use of Google Ads
Elma uses Google Ads to attract attention to their attractive offers with the help of advertising materials on external websites. Google Ads cookies usually lose their validity after 30 days and should not be used to personally identify you.
Use of Marketo and Munchkin code
Elma uses the services of Marketo, Inc. (“Marketo), https://documents.marketo.com/legal/privacy
in order to send newsletters and mailings to customers and prospects. Marketo is a marketing automation tool used by Elma to automate internal marketing processes.
Cookies are used which are saved on your device and which enable an analysis of your use of the website. For this purpose, a profile is created under a pseudonym; your IP address will be anonymized immediately. The analysis of your user behaviour serves to display usage-related content and interest-based advertising. The information generated by the cookie about your use of this website is transmitted on Elma’ behalf to a Marketo server within the EU and saved there. In individual cases, the data can also be transferred and saved on servers in the USA for advertising purposes. To ensure the adequacy of the data protection level, Marketo has submitted to the EU-US Privacy Shield. In addition, the Standard Contractual Clauses of the EU Commission were agreed with Marketo.
The data processing is based on the legal provisions of Art. 6 Paragraph 1 Sentence 1 Letter f GDPR and the corresponding provisions of the Swiss Data Protection Act (DSG). Elma’s concern in terms of the relevant data protection regulations is, in addition to the analysis of the use of the website, to regularly align the online shop in order to make it more attractive for the users of the website by using the obtained analysis for interest-based content and advertising.
Marketo Munchkin code allows the website to track visitor (from anywhere) behavior on the sites on which the cookie is installed and to link a visitor to the recipient of a marketing campaign, to measure campaign effectiveness. Tracking is performed anonymously until a user identifies himself/herself by submitting a form. Marketo forms used on the global Elma website enables collecting (global) customer requests for order and information, call back inquiries and schedule a call. Elma’s Marketo is also used to send out email newsletters. Subscribers (could be from anywhere) can manage their subscription settings anytime through the links to “Email Subscription Centre” or an “Unsubscribe” link at the bottom of the email.

Which data is processed and from which sources does this data come from?
We process the personal data, which we receive in the course of the business relationship, from you or from a distribution partner. In the case of a statutory or regulatory obligation, public authorities and institutions as well as our owners may be recipients of your personal data. With regard to the data disclosure to other third parties, we would like to point out that we only share your data, insofar as you have given us prior written and express instructions or insofar as we are legally obliged or authorised to do so.
How long is my data stored?
We store your personal data, insofar as expedient, for the duration of the entire business relationship (from initiation, over the execution through to the termination of a contract), as well as in accordance with statutory retention and documentation obligations, which among others result from the Austrian Corporate Code (UGB), the Austrian Federal Tax Code (BAO), etc. Moreover, required to be observed in the case of the storage period, are the statutory limitation periods, e.g. pursuant to the Austrian General Civil Law Code (ABGB).
Which data protection rights do I have?
You have at any given time a right to information, correction, deletion or restriction of the processing of your stored data, a right of objection against the processing as well as a right to data transferability in accordance with the requirements of data protection law. Am I obliged to provision data?
Within the framework of the business relationship, you must provide the personal data, necessary to enter into and conduct the business relationship, which we are required to collect by law. Personal data is only collected, insofar as you voluntarily disclose it to Elma, for example, for the purposes of the newsletter registration. Within the framework of Elma's personalized services, your registration data shall only be processed subject to your granted consent for the purposes of the shipment of newsletters or for the needs-based configuration of the offered electronic services. Export and processing of data in States outside of the European Economic Area
Insofar as an export of your personal data should take place to States outside of the European Economic Area (hereinafter EEA), Elma shall ensure that the data importer shall only process this data on the basis of a level of data protection, which is equivalent to the level of data protection, which the Elma in its capacity as the controller, is in turn obliged to comply with, pursuant to the relevant provisions of the EU-General Data Protection Regulation (EU-GDPR).
In addition, as long as you are logged-on to Facebook or own a Twitter account or a LinkedIn account or an Instagram account, personal data may be exported to the USA. Insofar as you are logged-on to Google or own a YouTube account, personal data may be exported to the USA. For further explanations and possibilities to prevent this data export, please refer to the section "Use of YouTube Plugins".
A transmission of personal data to Google within the framework of the use of analytical programs does in contrast not take place, because your IP address is only transmitted anonymously. Please read hereto the section "Use of analytical programs" of this data protection statement.
The service providers commissioned Elma have their registered offices as well as operate their IT infrastructure, exclusively within the EEA. This also applies to any use of cloud-based services. The contracts concluded with the service providers comply with the data protection and data security provisions of the EU General Data Protection Regulation (EU-GDPR). Elma remains the controller of the data processing, irrespective of the involvement of external service providers.
Use and disclosure of personal data
The personal data collected within the framework of Elma's website shall only be used without your granted consent for the purpose of the processing of the contract and the processing of your inquiries. In all other cases, your data shall only be used for advertising and market research purposes by Elma, insofar as you have previously granted your consent. Moreover, your data shall not be passed on to any third parties. You of course reserve the right to revoke your respective granted consent at any given time with effect for the future.

For your information, you shall find on Elma's web pages, links that refer to third-party websites. As far as this is not obvious, Elma points out that this is an external link. Use of cookies
Elma uses so-called "cookies" to individually design and optimize the customer's online experience and time online. A cookie is a text file that is either stored temporarily in the computer's memory ("session cookie") or stored on the hard disk ("persistent" cookie). Cookies entail e.g. information about the user's hitherto access to the respective server or respectively information about which offers have hitherto been called-up. Cookies are not used to run programs or to load viruses onto your computer. Session cookies

Persistent cookies
In addition, Elma uses "persistent cookies" to store the personal usage settings that a customer enters when using the services of Elma, thereby enabling personalization and improvement of the service. The persistent cookies ensure that the customer finds his personal settings again when he/she visits Elma's website again. In addition, the service providers who have been commissioned by Elma to analyse user behavior, use persistent cookies to recognize recurring users. These services store the data transmitted by the cookie only anonymously. An assignment to the IP address of the customer is not maintained.
Avoidance of cookies
The visitor has the possibility to reject the setting of cookies at any time. This is usually done by selecting the appropriate option on the cookie banner on Elma's website as well as in the browser settings or through additional programs. Insofar as the customer decides to deactivate cookies, this may reduce the performance scope of the services and as such to a significant extent negatively impact the use Elma's services.
Use of analytical programs
Elma performs or respectively commissions the performance of analytics on the behaviour of its customers within the framework of the use of its service. Anonymised or pseudonymised usage profiles are thereby created for this purpose. The creation of user profiles is effected for the sole purpose of constantly improving the service.
Elma also uses Google Analytics within the framework of the web analytics, a web analytics service provided by Google Inc. ("Google"), whereby Elma uses Google Analytics with the extension "_anonymizeIp ()". As a result, the IP addresses are processed only truncated to exclude a direct personal inference. Objection against the data collection and storage that takes place within this framework, can be raised at any given time with effect for the future.

Use of Facebook Social Plugins
Elma uses on its website social plugins ("plugins") of the social network facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). The plugins are marked with a Facebook logo. Insofar as the customer calls-up a webpage of the Elma containing such a plug-in, the customer's browser establishes a direct connection to the Facebook servers. Facebook transmits the content of the plugin directly to the customer's browser and it is then incorporated from this browser into the webpage.
Through the incorporation of the plugins, Facebook receives the information that the customer has called-up the respective webpage of Elma's website. Insofar as the customer is logged-on to Facebook, Facebook can assign the customer's visit to his/her Facebook account. Insofar as the customer interacts with the plugins, for example, presses the "Like" button or leaves a comment, the corresponding information is transmitted from the customer's browser directly to Facebook and stored there. Purpose and scope of the data collection and the further processing and use of the data by Facebook as well as the relevant rights and setting options of the customer to protect his privacy can be found in the privacy policy of Facebook.
Insofar as the customer does not want Facebook to collect data in the manner described above, the customer must log-off from Facebook before visiting the controller's website.
Use of Twitter
Elma uses functions of the service Twitter on its website. These features are provided by Twitter Inc., 1355 Market St, Suite 900, San Francisco, CA 94103, USA. By using Twitter and the "Re-Tweet" function, the websites you visit are linked to your Twitter account and shared with other users. This data is also thereby transmitted to Twitter. The cookies enable behavioral advertising and analytics by Twitter. Elma points out that Elma as the provider of the web pages are not aware of the content of the transmitted data as well as its use by Twitter. Elma uses functions of the services LinkedIn on its website. These features are provided by LinkedIn Inc., 599 N Mathilda Ave, Sunnyvale, CA 94085, USA. When you visit a webpage on Elma's website, which entails such a plugin, your browser connects directly to the servers of Instagram. Instagram thereby transmits the content of the plugin directly to your browser and from there it is incorporated into the webpage. Through this incorporation, Instagram receives the information that your browser has accessed the respective webpage of Elma's website, even if you do not have an Instagram profile or are currently not logged-on to Instagram. Use of YouTube-Plugins
Elma uses for the incorporation of videos, among others, the provider YouTube. YouTube is operated by YouTube LLC, with the principal place of business at 901 Cherry Avenue, San Bruno, CA 94066, USA. YouTube is represented by Google Inc., with registered offices at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Elma uses on its website plugins of the provider YouTube. When you visit a webpage of Elma's website, which has a YouTube plug-in, a connection to the server of YouTube is established. Information about the webpage you have visited is then transmitted over this connection to the YouTube server. Insofar as you are logged-on as a member of YouTube, YouTube assigns this information to your personal user account. In the case of the use of the plugin, such as by clicking on the start button of a video, this information is likewise assigned to your user account. You can prevent this assignment by logging-off from your YouTube user account as well as from other user accounts of the companies YouTube LLC and Google Inc. and deleting the corresponding cookies from the companies, before using Elma's website.

Use of RapidMail
Elma uses RapidMail for the processing of its non-individualized mail traffic, in particular the shipment of its newsletters, the sending of information material, feedback and advertising. RapidMail is a newsletter shipping platform of the German provider rapidmail GmbH, Augustinerplatz 2, 79098 Freiburg i. Br. Germany. Elma points out that the e-mail addresses of its newsletter recipients as well as other data is stored on the servers of RapidMail. RapidMail uses this data in particular for shipping and evaluating the newsletters on Elma's behalf. In addition, RapidMail is in a position to use this data for the continuous improvement of its own services. However, RapidMail does not use the data procured in this manner to address customers and website visitors for its own purposes nor does it disclose the data to third parties. Elma insofar trusts RapidMail’s reliability and IT as well as its data security, on account of the fact that RapidMail as German provider is committed to comply with the provisions of the of the EU-General Data Protection Regulation (EU-GDPR).
Use of Google Tag Manager
This website uses Google Tag Manager. Google Tag Manager is a solution that enables marketers to manage website tags from one interface. The tool itself (which implements the tags) is a cookie-less domain and does not collect personal information.
Use of Google Ads
Elma uses Google Ads to attract attention to their attractive offers with the help of advertising materials on external websites. Google Ads cookies usually lose their validity after 30 days and should not be used to personally identify you.
Use of Marketo and Munchkin code
Elma uses the services of Marketo, Inc. (“Marketo), https://documents.marketo.com/legal/privacy in order to send newsletters and mailings to customers and prospects. Marketo is a marketing automation tool used by Elma to automate internal marketing processes.
Cookies are used which are saved on your device and which enable an analysis of your use of the website. For this purpose, a profile is created under a pseudonym; your IP address will be anonymized immediately. The analysis of your user behaviour serves to display usage-related content and interest-based advertising. The information generated by the cookie about your use of this website is transmitted on Elma’ behalf to a Marketo server within the EU and saved there. In individual cases, the data can also be transferred and saved on servers in the USA for advertising purposes. To ensure the adequacy of the data protection level, Marketo has submitted to the EU-US Privacy Shield. In addition, the Standard Contractual Clauses of the EU Commission were agreed with Marketo.
The data processing is based on the legal provisions of Art. 6 Paragraph 1 Sentence 1 Letter f GDPR and the corresponding provisions of the Swiss Data Protection Act (DSG). Elma’s concern in terms of the relevant data protection regulations is, in addition to the analysis of the use of the website, to regularly align the online shop in order to make it more attractive for the users of the website by using the obtained analysis for interest-based content and advertising.
Marketo Munchkin code allows the website to track visitor (from anywhere) behavior on the sites on which the cookie is installed and to link a visitor to the recipient of a marketing campaign, to measure campaign effectiveness. Tracking is performed anonymously until a user identifies himself/herself by submitting a form. Marketo forms used on the global Elma website enables collecting (global) customer requests for order and information, call back inquiries and schedule a call. Elma’s Marketo is also used to send out email newsletters. Subscribers (could be from anywhere) can manage their subscription settings anytime through the links to “Email Subscription Centre” or an “Unsubscribe” link at the bottom of the email.

Which data is processed and from which sources does this data come from?
We process the personal data, which we receive in the course of the business relationship, from you or from a distribution partner. All commissioned data processors and distributors are contractually obliged to treat your data confidentially and to process it only within the framework of the provision of services. In the case of a statutory or regulatory obligation, public authorities and institutions as well as our owners may be recipients of your personal data. With regard to the data disclosure to other third parties, we would like to point out that we only share your data, insofar as you have given us prior written and express instructions or insofar as we are legally obliged or authorised to do so.
How long is my data stored?
We store your personal data, insofar as expedient, for the duration of the entire business relationship (from initiation, over the execution through to the termination of a contract), as well as in accordance with statutory retention and documentation obligations, which among others result from the Austrian Corporate Code (UGB), the Austrian Federal Tax Code (BAO), etc. Moreover, required to be observed in the case of the storage period, are the statutory limitation periods, e.g. pursuant to the Austrian General Civil Law Code (ABGB).
Which data protection rights do I have?
You have at any given time a right to information, correction, deletion or restriction of the processing of your stored data, a right of objection against the processing as well as a right to data transferability in accordance with the requirements of data protection law. Insofar as you are of the opinion that we violate national or European data protection laws when processing your data, we request you to contact us, to clarify your concerns. You can also address complaints to the competent data protection authority.
Am I obliged to provision data?
Within the framework of the business relationship, you must provide the personal data, necessary to enter into and conduct the business relationship, which we are required to collect by law. Elma uses so-called "cookies" to individually design and optimise the customer's online experience and time online. A cookie is a text file that is either stored temporarily in the computer's memory ("session cookie") or stored on the hard disk ("persistent" cookie). Cookies entail e.g. information about the user's hitherto access to the respective server or respectively information about which offers have hitherto been called-up. Cookies are not used to run programs or to load viruses onto your computer. Elma uses session cookies as well as persistent cookies.
Session cookies

In addition, Elma uses "persistent cookies" to store the personal usage settings that a customer enters when using the services of Elma, thereby enabling personalization and improvement of the service. In addition, the service providers who have been commissioned by Elma to analyse user behavior, use persistent cookies to recognize recurring users. Use of analytical programs
Elma performs or respectively commissions the performance of analytics on the behavior of its customers within the framework of the use of its service. Anonymised or pseudonymised usage profiles are thereby created for this purpose. The creation of user profiles is effected for the sole purpose of constantly improving the service.
Elma also uses Google Analytics within the framework of the web analytics, a web analytics service provided by Google Inc. ("Google"), whereby Elma uses Google Analytics with the extension "_anonymizeIp ()". As a result, the IP addresses are processed only truncated to exclude a direct personal inference. Objection against the data collection and storage that takes place within this framework, can be raised at any given time with effect for the future.

The plugins are marked with a Facebook logo. Insofar as the customer calls-up a webpage of Elma containing such a plug-in, the customer's browser establishes a direct connection to the Facebook servers. Facebook transmits the content of the plugin directly to the customer's browser and it is then incorporated from this browser into the webpage.
Through the incorporation of the plugins, Facebook receives the information that the customer has called-up the respective webpage of Elma's website. Insofar as the customer is logged-on to Facebook, Facebook can assign the customer's visit to his/her Facebook account. Insofar as the customer interacts with the plugins, for example, presses the "Like" button or leaves a comment, the corresponding information is transmitted from the customer's browser directly to Facebook and stored there. Elma uses functions of the service Twitter on its website. These features are provided by Twitter Inc., 1355 Market St, Suite 900, San Francisco, CA 94103, USA. By using Twitter and the "Re-Tweet" function, the websites you visit are linked to your Twitter account and shared with other users. This data is also thereby transmitted to Twitter. The cookies enable behavioral advertising and analytics by Twitter. Elma points out that Elma as the provider of the webpages is not aware of the content of the transmitted data as well as its use by Twitter. YouTube is represented by Google Inc., with registered offices at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Elma uses on its website plugins of the provider YouTube. When you visit a webpage of Elma's website, which has a YouTube plug-in, a connection to the server of YouTube is established. Information about the webpage you have visited is then transmitted over this connection to the YouTube server. Insofar as you are logged-on as a member of YouTube, YouTube assigns this information to your personal user account. In the case of the use of the plugin, such as by clicking on the start button of a video, this information is likewise assigned to your user account. You can prevent this assignment by logging-off from your YouTube user account as well as from other user accounts of the companies YouTube LLC and Google Inc. and deleting the corresponding cookies from the companies, before using Elma's website.

This website uses Google Tag Manager. Google Tag Manager is a solution that enables marketers to manage website tags from one interface. The tool itself (which implements the tags) is a cookie-less domain and does not collect personal information.

Elma uses Google Ads to attract attention to their attractive offers with the help of advertising materials on external websites. Google Ads cookies usually lose their validity after 30 days and should not be used to personally identify you.
Use of Marketo and Munchkin code
Elma uses the services of Marketo, Inc. (“Marketo), https://documents.marketo.com/legal/privacy
in order to send newsletters and mailings to customers and prospects. Marketo is a marketing automation tool used by Elma to automate internal marketing processes.
Cookies are used which are saved on your device and which enable an analysis of your use of the website. For this purpose, a profile is created under a pseudonym; your IP address will be anonymized immediately. The analysis of your user behaviour serves to display usage-related content and interest-based advertising. The information generated by the cookie about your use of this website is transmitted on Elma’ behalf to a Marketo server within the EU and saved there. In individual cases, the data can also be transferred and saved on servers in the USA for advertising purposes. To ensure the adequacy of the data protection level, Marketo has submitted to the EU-US Privacy Shield. In addition, the Standard Contractual Clauses of the EU Commission were agreed with Marketo.
The data processing is based on the legal provisions of Art. 6 Paragraph 1 Sentence 1 Letter f GDPR and the corresponding provisions of the Swiss Data Protection Act (DSG). Elma’s concern in terms of the relevant data protection regulations is, in addition to the analysis of the use of the website, to regularly align the online shop in order to make it more attractive for the users of the website by using the obtained analysis for interest-based content and advertising.
Marketo Munchkin code allows the website to track visitor (from anywhere) behavior on the sites on which the cookie is installed and to link a visitor to the recipient of a marketing campaign, to measure campaign effectiveness. Tracking is performed anonymously until a user identifies himself/herself by submitting a form. Marketo forms used on the global Elma website enables collecting (global) customer requests for order and information, call back inquiries and schedule a call. Elma’s Marketo is also used to send out email newsletters. Subscribers (could be from anywhere) can manage their subscription settings anytime through the links to “Email Subscription Centre” or an “Unsubscribe” link at the bottom of the email.

We process the personal data, which we receive in the course of the business relationship, from you or from a distribution partner. All commissioned data processors and distributors are contractually obliged to treat your data confidentially and to process it only within the framework of the provision of services. In the case of a statutory or regulatory obligation, public authorities and institutions as well as our owners may be recipients of your personal data. With regard to the data disclosure to other third parties, we would like to point out that we only share your data, insofar as you have given us prior written and express instructions or insofar as we are legally obliged or authorized to do so.
How long is my data stored?
We store your personal data, insofar as expedient, for the duration of the entire business relationship (from initiation, over the execution through to the termination of a contract), as well as in accordance with statutory retention and documentation obligations, which among others result from the Austrian Corporate Code (UGB), the Austrian Federal Tax Code (BAO), etc. Moreover, required to be observed in the case of the storage period, are the statutory limitation periods, e.g. pursuant to the Austrian General Civil Law Code (ABGB).
Which data protection rights do I have?
You have at any given time a right to information, correction, deletion or restriction of the processing of your stored data, a right of objection against the processing as well as a right to data transferability in accordance with the requirements of data protection law. Insofar as you are of the opinion that we violate national or European data protection laws when processing your data, we request you to contact us, to clarify your concerns. You can also address complaints to the competent data protection authority.
Am I obliged to provision data?
Within the framework of the business relationship, you must provide the personal data, necessary to enter into and conduct the business relationship, which we are required to collect by law. Insofar as you do not provide us with this data, we shall in principle be required to reject the conclusion of the contract or the execution of the contract or shall be unable to execute an existing contract and consequently must terminate it. Elma also uses Google Analytics within the framework of the web analytics, a web analytics service provided by Google Inc. ("Google"), whereby Elma uses Google Analytics with the extension "_anonymizeIp ()". As a result, the IP addresses are processed only truncated to exclude a direct personal inference. Objection against the data collection and storage that takes place within this framework, can be raised at any given time with effect for the future.

Elma uses on its website social plugins ("plugins") of the social network facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). The plugins are marked with a Facebook logo. Insofar as the customer calls-up a webpage of Elma containing such a plug-in, the customer's browser establishes a direct connection to the Facebook servers. Facebook transmits the content of the plugin directly to the customer's browser and it is then incorporated from this browser into the webpage.
Through the incorporation of the plugins, Facebook receives the information that the customer has called-up the respective webpage of Elma's website. Insofar as the customer is logged-on to Facebook, Facebook can assign the customer's visit to his/her Facebook account. Insofar as the customer interacts with the plugins, for example, presses the "Like" button or leaves a comment, the corresponding information is transmitted from the customer's browser directly to Facebook and stored there. Elma uses on its website plugins of the provider YouTube. When you visit a webpage of our website, which has a YouTube plug-in, a connection to the server of YouTube is established. Information about the webpage you have visited is then transmitted over this connection to the YouTube server. Insofar as you are logged-on as a member of YouTube, YouTube assigns this information to your personal user account. Newsletter2Go GmbH, Köpenicker Str. 126, 10179 Berlin. Elma points out that the e-mail addresses of its newsletter recipients as well as other data is stored on the servers of Newsletter2Go. Newsletter2Go uses this data in particular for shipping and evaluating the newsletters on Elma's behalf. In addition, Newsletter2Go is in a position to use this data for the continuous improvement of its own services. However, Newsletter2Go does not use the data procured in this manner to address Elma's customers and website visitors for its own purposes nor does it disclose the data to third parties. Elma insofar trusts Newsletter2Go’s reliability and IT as well as its data security, on account of the fact that Newsletter2Go as German provider is committed to comply with the provisions of the of the EU-General Data Protection Regulation (EU-GDPR).
Use of Google Tag Manager
This website uses Google Tag Manager. Google Tag Manager is a solution that enables marketers to manage website tags from one interface. The tool itself (which implements the tags) is a cookie-less domain and does not collect personal information.
Use of Google Ads
Elma uses Google Ads to attract attention to their attractive offers with the help of advertising materials on external websites. Google Ads cookies usually lose their validity after 30 days and should not be used to personally identify you.
Use of Marketo and Munchkin code
Elma uses the services of Marketo, Inc. (“Marketo), https://documents.marketo.com/legal/privacy in order to send newsletters and mailings to customers and prospects. Marketo is a marketing automation tool used by Elma to automate internal marketing processes.
Cookies are used which are saved on your device and which enable an analysis of your use of the website. For this purpose, a profile is created under a pseudonym; your IP address will be anonymized immediately. The analysis of your user behavior serves to display usage-related content and interest-based advertising. The information generated by the cookie about your use of this website is transmitted on Elma’ behalf to a Marketo server within the EU and saved there. In individual cases, the data can also be transferred and saved on servers in the USA for advertising purposes. To ensure the adequacy of the data protection level, Marketo has submitted to the EU-US Privacy Shield. In addition, the Standard Contractual Clauses of the EU Commission were agreed with Marketo.
The data processing is based on the legal provisions of Art. 6 Paragraph 1 Sentence 1 Letter f GDPR and the corresponding provisions of the Swiss Data Protection Act (DSG). Elma’s concern in terms of the relevant data protection regulations is, in addition to the analysis of the use of the website, to regularly align the online shop in order to make it more attractive for the users of the website by using the obtained analysis for interest-based content and advertising.
Marketo Munchkin code allows the website to track visitor (from anywhere) behavior on the sites on which the cookie is installed and to link a visitor to the recipient of a marketing campaign, to measure campaign effectiveness. Tracking is performed anonymously until a user identifies himself/herself by submitting a form. Marketo forms used on the global Elma website enables collecting (global) customer requests for order and information, call back inquiries and schedule a call. Elma’s Marketo is also used to send out email newsletters. In addition, commissioned data processors (such as operators of analytics tools, IT as well as back office service providers) and distributors, shall receive your personal data from us, insofar as they need the data to fulfil their respective provision of services. All commissioned data processors and distributors are contractually obliged to treat your data confidentially and to process it only within the framework of the provision of services.
In the case of a statutory or regulatory obligation, public authorities and institutions as well as our owners may be recipients of your personal data. With regard to the data disclosure to other third parties, we would like to point out that we only share your data, insofar as you have given us prior written and express instructions or insofar as we are legally obliged or authorized to do so.
How long is my data stored?
We store your personal data, insofar as expedient, for the duration of the entire business relationship (from initiation, over the execution through to the termination of a contract), as well as in accordance with statutory retention and documentation obligations. Elma performs or respectively commissions the performance of analytics on the behavior of its customers within the framework of the use of its service. Anonymised or pseudonymised usage profiles are thereby created for this purpose. The creation of user profiles is effected for the sole purpose of constantly improving the service.
Elma also uses Google Analytics within the framework of the web analytics, a web analytics service provided by Google Inc. ("Google"), whereby Elma uses Google Analytics with the extension "_anonymizeIp ()". As a result, the IP addresses are processed only truncated to exclude a direct personal inference. Objection against the data collection and storage that takes place within this framework, can be raised at any given time with effect for the future.

Elma uses on its website social plugins ("plugins") of the social network facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). The plugins are marked with a Facebook logo. Insofar as the customer calls-up a webpage of Elma containing such a plug-in, the customer's browser establishes a direct connection to the Facebook servers. Facebook transmits the content of the plugin directly to the customer's browser and it is then incorporated from this browser into the webpage.
Through the incorporation of the plugins, Facebook receives the information that the customer has called-up the respective webpage of Elma's website. Insofar as the customer is logged-on to Facebook, Facebook can assign the customer's visit to his/her Facebook account. Insofar as the customer interacts with the plugins, for example, presses the "Like" button or leaves a comment, the corresponding information is transmitted from the customer's browser directly to Facebook and stored there. Purpose and scope of the data collection and the further processing and use of the data by Facebook as well as the relevant rights and setting options of the customer to protect his privacy can be found in the privacy policy of Facebook.
Insofar as the customer does not want Facebook to collect data in the manner described above, the customer must log-off from Facebook before visiting Elma's website.
Use of Twitter
Elma uses functions of the service Twitter on its website. These features are provided by Twitter Inc., 1355 Market St, Suite 900, San Francisco, CA 94103, USA. By using Twitter and the "Re-Tweet" function, the websites you visit are linked to your Twitter account and shared with other users. This data is also thereby transmitted to Twitter. The cookies enable behavioral advertising and analytics by Twitter. Elma points out that Elma as the provider of the webpages is not aware of the content of the transmitted data as well as its use by Twitter. YouTube is represented by Google Inc., with registered offices at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Elma uses on its website plugins of the provider YouTube. When you visit a webpage of Elma's website, which has a YouTube plug-in, a connection to the server of YouTube is established. Information about the webpage you have visited is then transmitted over this connection to the YouTube server. Insofar as you are logged-on as a member of YouTube, YouTube assigns this information to your personal user account. In the case of the use of the plugin, such as by clicking on the start button of a video, this information is likewise assigned to your user account. You can prevent this assignment by logging-off from your YouTube user account as well as from other user accounts of the companies YouTube LLC and Google Inc. and deleting the corresponding cookies from the companies, before using Elma's website.

Use of Constant Contact
Elma uses Constant Contact for the processing of its non-individualised mail traffic, in particular the shipment of its newsletters, the sending of information material, feedback and advertising. Constant is a newsletter shipping platform of the US provider Constant Contact Inc., Waltham, Massachusetts (HO), Reservoir Plance, 1601 Trapelo Road, Waltham, MA 02451. Elma points out that the e-mail addresses of its newsletter recipients as well as other data is stored on the servers of Constant Contact. Constant uses this data in particular for shipping and evaluating the newsletters on Elma's behalf. In addition, Constant Contact is in a position to use this data for the continuous improvement of its own services. However, Constant Contact does not use the data procured in this manner to address our customers and website visitors for its own purposes nor does it disclose the data to third parties. Elma insofar trusts Constant Contact’s reliability and IT as well as its data security, on account of the fact that Constant Contact is certified under the US-EU Data Protection Agreement "Privacy Shield" and is committed to comply with appropriate standards, which correspond to the data protection level, pursuant to the provisions of the Swiss Data Protection Act (DSG).
Use of Google Tag Manager
This website uses Google Tag Manager. Google Tag Manager is a solution that enables marketers to manage website tags from one interface. The tool itself (which implements the tags) is a cookie-less domain and does not collect personal information.
Use of Google Ads
Elma uses Google Ads to attract attention to their attractive offers with the help of advertising materials on external websites. Google Ads cookies usually lose their validity after 30 days and should not be used to personally identify you.
Use of Marketo and Munchkin code
Elma uses the services of Marketo, Inc. (“Marketo), https://documents.marketo.com/legal/privacy
in order to send newsletters and mailings to customers and prospects. Marketo is a marketing automation tool used by Elma to automate internal marketing processes.
Cookies are used which are saved on your device and which enable an analysis of your use of the website. For this purpose, a profile is created under a pseudonym; your IP address will be anonymized immediately. The analysis of your user behaviour serves to display usage-related content and interest-based advertising. The information generated by the cookie about your use of this website is transmitted on Elma’ behalf to a Marketo server within the EU and saved there. In individual cases, the data can also be transferred and saved on servers in the USA for advertising purposes. To ensure the adequacy of the data protection level, Marketo has submitted to the EU-US Privacy Shield. In addition, the Standard Contractual Clauses of the EU Commission were agreed with Marketo.
The data processing is based on the legal provisions of Art. 6 Paragraph 1 Sentence 1 Letter f GDPR and the corresponding provisions of the Swiss Data Protection Act (DSG). Elma’s concern in terms of the relevant data protection regulations is, in addition to the analysis of the use of the website, to regularly align the online shop in order to make it more attractive for the users of the website by using the obtained analysis for interest-based content and advertising.
Marketo Munchkin code allows the website to track visitor (from anywhere) behavior on the sites on which the cookie is installed and to link a visitor to the recipient of a marketing campaign, to measure campaign effectiveness. Tracking is performed anonymously until a user identifies himself/herself by submitting a form. Marketo forms used on the global Elma website enables collecting (global) customer requests for order and information, call back inquiries and schedule a call. Elma’s Marketo is also used to send out email newsletters. Subscribers (could be from anywhere) can manage their subscription settings anytime through the links to “Email Subscription Centre” or an “Unsubscribe” link at the bottom of the email.

Which data is processed and from which sources does this data come from?
We process the personal data, which we receive in the course of the business relationship, from you or from a distribution partner. In addition, we process data which we have where expedient procured in a legally permissible manner, from publicly available sources (e.g. company register, club register, land register, media). Who receives my data?

In addition, commissioned data processors (such as operators of analytics tools, IT as well as back office service providers) and distributors, shall receive your personal data from us, insofar as they need the data to fulfil their respective provision of services. All commissioned data processors and distributors are contractually obliged to treat your data confidentially and to process it only within the framework of the provision of services. In the case of a statutory or regulatory obligation, public authorities and institutions as well as our owners may be recipients of your personal data. With regard to the data disclosure to other third parties, we would like to point out that we only share your data, insofar as you have given us prior written and express instructions or insofar as we are legally obliged or authorised to do so.
How long is my data stored?
We store your personal data, insofar as expedient, for the duration of the entire business relationship (from initiation, over the execution through to the termination of a contract), as well as in accordance with statutory retention and documentation obligations, which among others result from the Austrian Corporate Code (UGB), the Austrian Federal Tax Code (BAO), etc. Moreover, required to be observed in the case of the storage period, are the statutory limitation periods, e.g. pursuant to the Austrian General Civil Law Code (ABGB).
Which data protection rights do I have?
You have at any given time a right to information, correction, deletion or restriction of the processing of your stored data, a right of objection against the processing as well as a right to data transferability in accordance with the requirements of data protection law. If you sign up for more information, the information you provide in the form will be sent to us. We use that information to respond to you and provide ongoing information about our services.
We also track statistics in aggregate across our site (we currently use Google Analytics, whose terms of service for US users and privacy policy can be found here), in order to provide better quality of service, and we may sometimes share that data in aggregate. You can also opt-out of Google Analytics here. We make use of third-party software to do so but we do not provide such third-party software providers with any of your personal information.

We currently use third parties (Rackspace) to store data on premises and in the future we may use a cloud-based service like Microsoft Azure.
Payment Processing
In order to process your payment, Elma uses a payment processor to process your payment. In order to do that, Elma will send to the processor, and the processor will receive, the payment information that you provide. The payment process is responsible for all onward transfers of personal information to third parties in accordance with the EU-U.S. Privacy Shield Framework, the Swiss-U.S. Privacy Shield Framework, and Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). We currently use authorize.net and it’s payment processor functionality through a plug-in to SiteCore.
External Links
Elma’s Site contains links that refer to third-party websites. We have no influence on the content and design of these websites of other providers. Therefore, the guarantees of this data protection statement do not apply to external providers.

Marketo is a marketing automation tool used by us to automate internal marketing processes,to manage advertising permissions and data on the use of the Sites, and to optimize our offerings accordingly. You can prevent the cookies from being saved by modifying your browser settings accordingly. And you can effectively prevent tracking if you deactivate the display of images by default in your email program. In this case, the newsletter is not completely displayed and the user may not be able to use all the features. Marketo Munchkin code allows the Site to track your (from anywhere) behaviour on the sites on which the cookie is installed and to link a visitor to the recipient of a marketing campaign, which we use to measure campaign effectiveness. Tracking is performed without associating you to a nameuntil you submit a form. Marketo forms used on the Sites enables us to respond tocustomer requests for orders and information and call back inquiries.
Customer Relationship Management
We use a CRM (currently Dynamics 365) to help us store and organize customer data. This includes purchase history, newletter subscriptions, and service issues. Dynamics 365’s privacy policy is here. And we use Sitecore as a Content Management System.

Elma does not respond to Do Not Track signals that you set in your browser.

We try our best to provide you with leading security practices, like encrypting all requests via a secure connection (HTTPS), physical access controls, and password protection. However, no data transmission on the internet or on a network is 100% secure, so we cannot make a guarantee. Data Retention
Elma retains data only for so long as needed for the uses we identify above. If you wish to end your account or no longer wish to receive emails from Elma, you can request deletion below. Otherwise, we retain account information for active accounts. Our backups of data are kept for one year.
Change of Control
If Elma is ever involved in a bankruptcy, merger, acquisition, reorganization, or sale of assets, your information may be sold or transferred as part of that transaction. The promises in this policy will apply to your information as transferred to the new entity, including your right to delete your information.
Government Requests
Notwithstanding anything to the contrary in this policy, we may preserve or disclose your information if we believe that it is reasonably necessary to comply with a law, regulation, or legal request or to protect the safety, property, or rights of Elma or others. However, nothing in this policy is intended to limit any legal defenses or objections that you may have to a third party or government request to disclose your information. If you are a customer of the Services in the national defense industry and Elma receives a law enforcement request from a government other than where you are headquartered, Elma will give you notice unless we are prohibited from doing so and will assist you in objecting to that (at your expense).
